This Privacy Policy ("Policy") governs the collection, use, disclosure, and retention of personal information by Grade My Landlord ("we," "us," or "our") in connection with our website and platform located at grademylandlord.com (the "Platform"). By accessing or using the Platform, you acknowledge that you have read, understood, and agree to the practices described in this Policy.
We are committed to complying with the Personal Information Protection and Electronic Documents Act (PIPEDA), applicable provincial privacy legislation including the Personal Information Protection Act (PIPA) in British Columbia and Alberta, and Quebec's Act respecting the protection of personal information in the private sector (Law 25), as amended from time to time.

4.1 Service Providers
We engage trusted third-party service providers (such as hosting providers, authentication services, and email delivery services) who process personal information on our behalf and under our instruction. All such providers are contractually required to: (a) use personal information solely to perform the contracted services; (b) maintain appropriate technical and organisational security measures; and (c) not disclose or use the information for any other purpose.
4.2 Legal Requirements and Protection of Rights
We may disclose personal information if we reasonably believe disclosure is necessary to: (a) comply with a legal obligation, court order, subpoena, or lawful government request; (b) enforce our Terms of Service or other agreements; (c) protect the rights, property, or safety of Grade My Landlord, our users, or the public; or (d) detect, prevent, or address fraud or security incidents.
Where legally permissible, we will provide you with notice before disclosing your information in response to a legal request.
4.3 Identification in Defamation Proceedings
You acknowledge that in the event a court of competent jurisdiction issues an order requiring us to identify the author of specific content (including in the context of defamation proceedings), we may be required to disclose your identifying information. We will comply with such orders to the extent legally required. Where permitted by law, we will seek to notify you of such an order before complying.
4.4 Business Transfers
In the event of a merger, acquisition, reorganisation, or sale of all or substantially all of our assets, your personal information may be transferred to the successor entity. We will provide notice of such a transfer and the successor will be bound by privacy commitments no less protective than this Policy.

These measures include encrypted connections (HTTPS/TLS), access controls limiting information access to authorised personnel, and regular security reviews.
No method of transmission over the internet or method of electronic storage is completely secure. While we strive to protect your information, we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your login credentials and for any activity that occurs under your account.
Your personal information may be stored or processed in jurisdictions outside of Canada, including in the United States, where privacy laws may differ from those in your province of residence. Where such transfers occur, we take steps to ensure that your information is afforded a comparable level of protection, including through contractual obligations with service providers.
The Platform is not directed to individuals under the age of 18. We do not knowingly collect personal information from minors. If we become aware that we have collected personal information from a person under 18 without appropriate consent, we will delete that information promptly.
We may update this Policy from time to time. Where changes are material, we will provide notice by posting the updated Policy on the Platform and updating the effective date. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Grade My Landlord ("we," "us," or "our") governing your access to and use of the Platform located at grademylandlord.com, including all content, features, and services offered therein.
BY ACCESSING OR USING THE PLATFORM, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS IN THEIR ENTIRETY. IF YOU DO NOT AGREE, YOU MUST NOT ACCESS OR USE THE PLATFORM.
These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.
You must be at least 18 years of age to create an account, submit reviews, or otherwise use the Platform. By using the Platform, you represent and warrant that: (a) you are at least 18 years of age; (b) you have the legal capacity to enter into a binding agreement; and (c) your use of the Platform does not violate any applicable law or regulation.
We reserve the right to verify your eligibility at any time and to suspend or terminate your account if we have reason to believe you do not meet these requirements.
Grade My Landlord operates as a passive intermediary hosting platform. We do not create, originate, author, or commission any User Content (as defined below). We do not pre-screen, review, verify, endorse, approve, or adopt User Content prior to its publication on the Platform.
Any moderation, filtering, or removal of content that we undertake is performed at our sole discretion for the purpose of maintaining community standards and does not constitute editorial control, adoption, or endorsement of any User Content. Such moderation activities do not render us the publisher or speaker of User Content for any legal purpose.
You acknowledge that we are not liable for any User Content posted by any User, including you, and that we bear no responsibility for the accuracy, completeness, truthfulness, legality, or appropriateness of any User Content.
4.1 Your Responsibility
You are solely and exclusively responsible for all content you post, upload, transmit, or otherwise make available on or through the Platform, including reviews, ratings, forum posts, comments, and any other materials (collectively, "User Content"). You represent and warrant that:

By submitting User Content to the Platform, you grant Grade My Landlord a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, transferable, and sublicensable licence to use, reproduce, display, distribute, modify (including for formatting purposes), and create derivative works from your User Content for the purposes of operating, maintaining, and improving the Platform. This licence survives the deletion of your account or any User Content to the extent that copies have been made in the ordinary course of our backup and archival processes.
4.3 Prohibited Content
You agree not to post User Content that:
Reviews submitted to the Platform must be based on genuine, direct personal experience as a tenant, former tenant, or landlord. Reviews are the opinions of individual Users and constitute expressions of honest opinion on matters of public interest — they do not represent the views, findings, or opinions of Grade My Landlord.
We reserve the right, at our sole discretion and without prior notice or liability, to remove, edit, or refuse to display any review or other User Content that we reasonably believe: (a) violates these Terms; (b) is fraudulent, fabricated, or submitted in bad faith; (c) infringes the rights of any third party; or (d) exposes us or any third party to legal liability.
The removal or non-removal of any User Content does not constitute an endorsement or confirmation of the accuracy or legality of that content.
If you believe that content posted on the Platform is defamatory, infringes your intellectual property rights, or otherwise violates applicable law, you may submit a written takedown request to us at:

Your request must include: (a) your full name and contact information; (b) the specific URL(s) of the content you are reporting; (c) a detailed description of the basis for your complaint, including the specific statements you allege to be false or unlawful and why; (d) a declaration that the information in your notice is accurate; and (e) where applicable, proof of your identity or authority to make the request.
We will review all complete and valid notices in good faith and respond within ten (10) business days. We reserve the right to determine, in our sole discretion, whether to remove content in response to a notice. Receipt of a notice does not constitute an admission that the content is unlawful or that we have any legal obligation to remove it.
We reserve the right to share the contents of a notice with the User who posted the reported content.
All content on the Platform other than User Content, including the Platform's design, graphics, logos, software, and underlying technology (collectively, "Platform Content"), is owned by or licensed to Grade My Landlord and is protected by applicable copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any Platform Content without our prior written consent. Nothing in these Terms transfers any intellectual property rights to you.
You agree to indemnify, defend, and hold harmless Grade My Landlord and its officers, directors, shareholders, employees, agents, successors, and assigns (collectively, the "Indemnified Parties") from and against any and all claims, actions, demands, proceedings, damages, losses, liabilities, costs, and expenses (including reasonable legal fees and disbursements) arising out of or relating to:
We reserve the right to assume exclusive control of any matter subject to indemnification by you, in which case you agree to cooperate with us in asserting any available defences. This indemnification obligation will survive termination of these Terms and your use of the Platform.
THE PLATFORM AND ALL CONTENT, FEATURES, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GRADE MY LANDLORD EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
We do not guarantee that any review, rating, or other User Content reflects an accurate or truthful account of any landlord or tenancy experience. You rely on User Content at your own risk. Always conduct your own independent due diligence before entering into any tenancy agreement.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GRADE MY LANDLORD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY:
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM EXCEED THE GREATER OF: (A) THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. To the extent such exclusions or limitations are not permitted by applicable law, our liability will be limited to the minimum extent permitted.

Termination of your account does not relieve you of any obligations arising prior to termination, including your indemnification obligations. We shall not be liable to you or any third party for termination of your access to the Platform.
These Terms and any dispute arising out of or in connection with them are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to any conflict of law principles that would cause the laws of another jurisdiction to apply.
You irrevocably consent to the exclusive jurisdiction and venue of the courts of British Columbia for the resolution of any dispute arising out of or relating to these Terms or your use of the Platform. Nothing in this section limits our right to seek injunctive or other equitable relief in any court of competent jurisdiction.
We reserve the right to modify, suspend, or discontinue the Platform or any feature thereof at any time, without notice or liability. We may update these Terms from time to time. Where changes are material, we will provide notice by posting the updated Terms on the Platform and updating the effective date. Your continued use of the Platform after such changes constitutes your acceptance of the revised Terms.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Grade My Landlord with respect to the subject matter herein and supersede all prior or contemporaneous agreements, representations, or understandings, whether oral or written.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, without affecting the validity and enforceability of the remaining provisions.
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. Any waiver must be in writing and signed by an authorised representative of Grade My Landlord to be effective.
